Terms and Conditions

1. About Us
1.1 Global Travel Studio (Pty) Ltd (“the Agency”, “we”, “us”, “our”) acts solely as an intermediary between clients and independent third-party travel suppliers, including but not limited to airlines, hotels, tour operators, cruise lines, car rental companies, insurance providers, and destination management companies.
1.2 The Agency does not own, control, or operate any travel services.
1.3 By requesting a quotation, making payment, or confirming a booking, the client agrees to be bound by:

These Terms & Conditions; and

The Terms & Conditions of all third-party suppliers relevant to the booking.
2. Quotations & Pricing
2.1 All quotations are subject to availability at the time of booking.
2.2 Prices are subject to change without notice due to:
-
Supplier increases
-
Exchange rate fluctuations
-
Fuel surcharges
-
Government taxes or levies
-
Availability changes
2.3 No quotation is guaranteed until full cleared payment has been received and written confirmation has been issued.
2.4 Errors or omissions in quotations may be corrected without prior notice.
2.5 Certain destinations impose resort fees, city taxes, tourist taxes, conservation levies, or similar charges payable directly by the client upon arrival. Unless explicitly stated, these are excluded from quoted pricing.
3. Payments
3.1 A deposit may be required to secure a booking.
3.2 Full payment must be made by the deadline stated on the invoice.
3.3 Bookings will only be issued, ticketed, or confirmed once cleared funds reflect in the Agency’s bank account. This applies to:

Credit card payments
-
Virtual card payments
-
Direct deposits
-
Electronic transfers
3.4 Proof of payment will not be accepted as confirmation of funds received.
3.5 All bank charges, currency conversion costs, international transfer fees, and merchant fees are for the client’s account.
3.6 Failure to make payment by the due date may result in automatic cancellation by suppliers, and cancellation penalties may apply.
4. Chargebacks & Payment Disputes
4.1 By making payment via credit card or electronic method, the client confirms that they are the authorised cardholder and that the transaction is valid and authorised.
4.2 Once services are confirmed or ticketed, the Agency incurs immediate financial obligations to third-party suppliers.
4.3 Initiating a chargeback or payment dispute for validly authorised and confirmed services constitutes a material breach of these Terms & Conditions.
4.4 In the event of a chargeback:

The client remains liable for the full booking amount,

Plus supplier penalties,
-
Plus chargeback and banking fees,
-
Plus legal and recovery costs.
4.5 The Agency reserves the right to:
-
Institute legal proceedings,
-
Recover debt collection costs,
-
List outstanding amounts with a registered credit bureau (where legally permissible),
-
Refuse future services.
4.6 Supplier confirmations, invoices, and acceptance of these Terms & Conditions constitute sufficient evidence of a valid transaction.
5. Cancellations & Refunds
5.1 Cancellation fees are determined by individual suppliers and may range from partial to 100% of the booking value.
5.2 Professional service and consultation fees charged by the Agency are non-refundable.
5.3 Refund processing times are subject to supplier and banking timelines and are outside the Agency’s control.
5.4 The Agency is not responsible for supplier insolvency or delayed refunds.
6. Changes & Amendments
6.1 Any amendments after confirmation may incur additional supplier penalties and Agency service fees.
6.2 Name corrections, date changes, routing amendments, and reissues are subject strictly to supplier fare rules and availability.
6.3 The Agency cannot guarantee availability or pricing for amended bookings.
7. Travel Insurance
7.1 Comprehensive travel insurance is strongly recommended.
7.2 Insurance should include cover for:

Cancellation
-
Medical emergencies
-
Repatriation
-
Travel disruption
-
Car rental excess
-
Luggage loss
7.3 Certain destinations may require mandatory insurance as a condition of entry.
7.4 The Agency accepts no liability for losses that could have been covered by adequate insurance.
8. Passports, Visas, Entry & Health Requirements
8.1 Clients are solely responsible for ensuring compliance with all passport, visa, transit visa, vaccination, and health requirements. You may refer to https://apply.joinsherpa.com/travel-restrictions, alternatively your Airline or Embassy website for information.
8.2 Passport validity must meet destination requirements (typically minimum six months validity and sufficient blank pages).
8.3 Entry regulations may change without notice.
8.4 The client must independently verify all requirements with official consulates or authorities.
8.5 The Agency accepts no liability for denied boarding, refused visas, or denied entry due to incorrect or incomplete documentation.

9. Car Hire
9.1 A valid credit card in the name of the primary driver is required at vehicle collection.
9.2 A security deposit (pre-authorisation) will be held on the driver’s credit card for the duration of hire.
9.3 The deposit will be released by the rental supplier after vehicle return, subject to:

Return in agreed condition
-
Fuel policy compliance
-
Deduction of damages, traffic fines, administrative charges, or insurance excess
9.4 The Agency is not responsible for disputes relating to car rental deposits or damage claims.
10. Responsibility & Intermediary Role
10.1 The Agency acts solely as an intermediary.
10.2 The Agency shall not be liable for:

Supplier failures or insolvency
-
Flight delays or cancellations
-
Schedule changes
-
Acts of God
-
Political unrest or strikes
-
Government restrictions
-
Illness, injury, or death
-
Loss or theft of personal belongings
-
Additional insurance requirements imposed by governments
10.3 All services remain subject to supplier terms and conditions.
11. Indemnity
11.1 The client indemnifies and holds harmless Global Travel Studio (Pty) Ltd, its directors, shareholders, employees, and representatives against any claims, damages, losses, penalties, or expenses arising from:

Supplier acts or omissions
-
Visa refusals or entry denial
-
Government actions
-
Medical emergencies
-
Client negligence or misconduct
12. Limitation of Liability
12.1 To the maximum extent permitted by South African law, the total liability of the Agency shall be limited to the professional service fees paid directly to the Agency for the specific booking giving rise to the claim.
12.2 Under no circumstances shall the Agency be liable for:

Indirect or consequential loss

Loss of enjoyment
-
Loss of income or business
-
Emotional distress
-
Additional accommodation or transport costs
12.3 The Agency shall not be liable for any amount exceeding the commission or service fees earned on the booking.
12.4 Any claim must be instituted within 90 days of travel completion, failing which such claim shall prescribe.
13. Force Majeure
The Agency shall not be liable for events beyond its control including natural disasters, pandemics, border closures, airline strikes, war, civil unrest, or government regulations.
14. Corporate Structure & Director Protection
14.1 Global Travel Studio operates as a registered South African (Pty) Ltd company.
14.2 All agreements are concluded with the company as a separate legal entity.
14.3 No director, shareholder, or employee shall be personally liable for any claim except in cases of proven gross negligence or fraud.
14.4 Any legal proceedings shall be brought solely against the registered company.
15. Privacy & POPIA Compliance
15.1 Client information is collected solely for booking and travel purposes.
15.2 The Agency complies with the Protection of Personal Information Act (POPIA).
15.3 Information may be shared with suppliers strictly as required to process bookings.
16. Complaints & Disputes
16.1 Complaints must be submitted in writing within 14 days of travel completion.
16.2 The Agency will act as intermediary but cannot guarantee outcomes.
16.3 All disputes are governed by the laws of South Africa.
17. Acceptance of Terms
Payment of a deposit or full amount constitutes acceptance of these Terms & Conditions.
